If a loved one passes away with any asset in their name alone, meaning this asset is not held in a trust or was not held jointly with another person, probate must be opened with the relevant Probate Court in order for that asset to be distributed appropriately.

GUARDIANSHIP

A legal guardian is a person who has been appointed by a court to make decisions relevant to the personal and property interests of another person who is deemed incompetent, called a ward.

CONSERVATORSHIPS

Conservatorship is a legal process in which the Massachusetts Probate and Family Court appoints a person, called a Conservator, to make certain decisions on behalf of someone who is mentally or physically unable to care for themselves.
